नई दिल्ली (वीकैंड रिपोर्ट) : New Criminal Law : एक जुलाई 2024 की तारीख से भारत में नए आपराधिक कानून लागू किये गए हैं। अंग्रेजों के समय से चलते आ रहे भारतीय दंड संहिता 1860, दंड प्रक्रिया संहिता, 1973 और भारतीय साक्ष्य अधिनियम 1872 अब ख़त्म कर दिए गए हैं। अब इनकी जगह भारतीय न्याय संहिता, भारतीय नागरिक सुरक्षा संहिता और भारतीय साक्ष्य अधिनियम ने ले ली है। आपको बता दें कि इन कानूनों से जुड़े विधेयक को बीते साल संसद के दोनों सदनों लोकसभा और राज्यसभा से पास करवाया गया था। बहुत सारे राजनीतिक दल इस कानूनों के पक्ष में नहीं है। आपको बताते हैं कि इन नए कानूनों से क्या फायदा होगा-
किसी भी क्षेत्र में दर्ज करवा सकोगे FIR
‘जीरो एफआईआर’ से अब कोई भी व्यक्ति किसी भी पुलिस थाने में अपनी शिकायत दर्ज करवा सकता है मतलब कि अगर किसी व्यक्ति के साथ कही भी कोई घटना हो जाती है तो वो वही के थाने में FIR दर्ज करवा सकता है। नए कानून की एक दिलचस्प बात यह भी है कि जब पुलिस किसी को व्यक्ति गिरफ्तार करती है वो व्यक्ति इसकी जानकारी अपने किसी करीबी या अपने परिवार वालों को दे सकता है। इससे गिरफ्तार व्यक्ति को तुरंत सहयोग मिल सकेगा।
45 din के अंदर होगा फैसला
गृह मंत्री अमित शाह ने कहा था कि इन कानूनों को भारतीयों ने, भारतीयों के लिए और भारतीय संसद द्वारा बनाया गया है तथा यह औपनिवेशिक काल के न्यायिक कानूनों का खात्मा करते हैं। नये कानूनों के मुताबिक जब किसी व्यक्ति पर कोई मामला दर्ज होता है तो इसका फैसला मुकदमा पूरा होने के 45 दिन के अंदर आ जायेगा। और पहली सुनवाई होने पर उसका आरोप 60 दिन के अंदर तय किया जायेगा।

New Criminal Law : रेप से लेकर मॉब लिंचिंग तक के लिए नए प्रावधान
दुष्कर्म से पीड़ित औरतों के बयान कोई महिला पुलिस अधिकारी उसके अभिभावक या रिश्तेदार की मौजूदगी में ही दर्ज करेगी पीड़ित औरत अकेली अपने बयान नहीं दे सकती और मेडिकल रिपोर्ट देने के लिए सात दिन का समय तय किया गया है। इसके अलावा सभी जघन्य अपराधों के वारदात स्थल की अनिवार्य वीडियोग्राफी जैसे प्रावधान शामिल किए गए हैं। इसके अलावा मॉब लिंचिंग के मामले में फांसी की सजा सुनाने का प्रावधान किया गया है।
कई नए प्रावधान भी जुड़े
नए कानून में महिलाओं और बच्चों के लिए खास कानून बनाया गया है, इस कानून के तहत किसी बच्चे को खरीदना और बेचना अपराध माना गया। अगर कोई व्यक्ति किसी नाबालिग से सामूहिक दुष्कर्म करता है तो इसके लिए उसे मृत्युदंड या उम्रकैद की सजा दी जाएगी। इसके इलावा शादी का झूठा वादा करने, नाबालिग से दुष्कर्म, भीड़ द्वारा पीटकर हत्या करने, झपटमारी आदि मामले दर्ज किए जाते हैं लेकिन मौजूदा भारतीय दंड संहिता में ऐसी घटनाओं से निपटने के लिए कोई विशेष प्रावधान नहीं थे। उन्होंने बताया कि भारतीय न्याय संहिता में ऐसे अपराधों से निपटने के लिए प्रावधान किये गए हैं। नए कानून में महिलाओं, पंद्रह वर्ष की आयु से कम उम्र के लोग, 60 वर्ष की आयु से अधिक के लोग तथा दिव्यांग या गंभीर बीमारी से पीड़ित लोग जो पुलिस थाने नहीं आ सकते उन्हें छूट दी जाएगी और वह अपने निवास स्थान पर ही पुलिस सहायता प्राप्त कर सकते हैं।
क्या है जानकारों की विचार
इन कानूनों को लेकर कानूनी विशेषज्ञों ने भी अपनी-अपनी राय दी है। कानूनी विशेषज्ञों का कहना है कि अब कानून लागू करने वाली एजेंसियों, न्यायिक अधिकारियों और कानूनी पेशेवरों के लिए आगे बड़ी चुनौतियां हैं। उन्होंने कहा कि यह कानून बड़ी संख्या में नागरिकों को उनके जीवन में किसी न किसी समय प्रभावित करेंगे। कई कानूनी जानकारों की ये भी दलील है कि नए आपराधिक कानूनों में, कानून प्रवर्तन एजेंसियों को बिना किसी नियंत्रण और संतुलन के निरंकुश शक्तियां दी गई हैं जिससे खतरा भी हो सकता है।

New Criminal Law : विपक्षी दलों के विचार ?
नए आपराधिक कानून अभी लागू होने है लेकिन इसके पहले बंगाल की सीएम ममता बनर्जी समेत कई अन्य नेताओं ने केंद्र सरकार को पत्र लिखा। पत्र लिख कर उन्होंने इस नए कानूनों को रोकने की मांग की थी। कांग्रेस समेत कई विपक्षी दल इस कानून का विरोध कर रहे हैं। विपक्षी दलों का कहना है कि इस कानून को बिना किसी व्यापक चर्चा के लागू किया गया है। विपक्ष ने मांग की है कि संसद नए आपराधिक कानूनों की फिर से दुबारा जांच करे, उनका दावा है कि ये देश को पुलिस राज्य में बदलने की नींव रखते हैं।
